Was it Preventable or Was it an Accident?
In personal injury cases we are instrumental in separating preventable occurrence from the purely accidental. This comes very close to helping determine what was done right and what went wrong. Were OSHA standards practiced on the construction site? Was the surface properly prepared for pedestrian travel in wet conditions? Did the pressure of the door swing exceed that allowable by the ADA?
For claimants in these cases, even more emotions than with property claims are involved because someone got hurt or worse. Still, we have to look at only the facts of each case and provide answers to what could have been prevented? what is unexplainable, as in a true accident? and what are the proportions of responsibility assignable to each party? Truly, this work cannot help heal the injured or provide comfort for the loss. In these cases, the answers we provide serve only to assist in the allocation of monetary compensation. We’d like to think that assists our clients just a bit, taking care of a necessary evil that they might not be able to face on their own.
